The Australian Securities & Investments Commission announced that Rohan Rex Greyling, a former director of Nomad Developments Pty Ltd, has been convicted and fined AUD 1,000 for making a false or misleading statement to ASIC. The conviction also triggers an automatic five-year disqualification from managing corporations. ASIC’s investigation found Mr Greyling lodged a Form 6010 to voluntarily deregister Nomad Developments on 20 December 2023 declaring the company had no outstanding liabilities, when it was alleged the company owed AUD 34,885 to the Queensland Building and Construction Commission. Mr Greyling was the sole director at the time and was aware of the debt prior to submitting the form; the matter was prosecuted by the Office of the Director of Public Prosecutions (Cth) following a referral from ASIC. ASIC noted that, when dealt with summarily, the offence carries a jurisdictional limit of 12 months’ imprisonment and/or a fine of up to 60 penalty units (AUD 18,780).
