Thailand’s Securities and Exchange Commission (SEC) is consulting on draft rules clarifying when investment advice distributed through media, including online channels, falls outside regulated securities and derivatives advisory business. The proposed exclusion would cover advice from bona fide publishers that is disseminated broadly to the public and is not tailored to an individual’s investment objectives, financial position or needs. The draft follows consultation on the underlying principles in September–October 2026. Qualifying publishers would need to regularly and consistently produce, compile or disseminate news or information to the public, with systems for overseeing and taking responsibility for their content. They would also need to separate information dissemination from their other services, and income from dissemination must not be linked to recipients’ investment decisions. A separate amendment would align the institutional investor definition with the definition under existing business conduct standards for securities companies and derivatives intermediaries.
Thailand’s Securities and Exchange Commission consults on draft exemption criteria for media investment advice
Thailand’s Securities and Exchange Commission is consulting on draft rules excluding broadly disseminated, nonpersonalized media advice from regulated securities and derivatives advisory business when provided by qualifying publishers. Publishers would need content oversight, separation from other services and dissemination income unrelated to recipients’ investment decisions. Following an earlier consultation on the principles, the draft would also align the institutional investor definition with existing business conduct standards.
