The Australian Securities & Investments Commission has cancelled the Australian credit licence of Sydney-based credit licensee John Adicho, citing failures to meet ongoing compliance, dispute resolution membership and funding obligations. The regulator pointed to Mr Adicho’s failure to lodge six annual compliance certificates, expulsion from the Australian Financial Complaints Authority for non-payment of fees, and unpaid industry funding levies owed to ASIC. ASIC referenced its powers under the National Consumer Credit Protection Act 2009 to cancel or suspend a licence where levies remain unpaid for at least 12 months after the due date and where general conduct obligations are breached, including AFCA membership and compliance with credit legislation. Mr Adicho may apply to the Administrative Review Tribunal for review of the decision.
