Responses will feed into a Commission report to the European Parliament and the Council required under the Markets in Financial Instruments Directive (MiFID), which is intended to inform potential future policy initiatives. The consultation is seeking stakeholder input on how current rules affect the efficiency and resilience of EU commodity derivatives markets and relevant parts of spot energy markets. It covers all commodity derivatives, not only energy, and includes consideration of where regulatory burdens on EU companies could be reduced where feasible; the review is positioned in the context of lessons from the recent energy crisis and recommendations in Mario Draghi’s competitiveness report relating to energy spot and derivatives markets.
