Brazilian Superintendence of Private Insurance (SUSEP) announced the publication of a National Council of Private Insurance (CNSP) resolution adjusting the mandatory Vehicle Civil Liability Insurance (RC-V) required for road cargo transport, so that compulsory coverage applies only to events occurring during the effective provision of the transport service. CNSP Resolution No. 488 of 10 March 2026 amends CNSP Resolution No. 478/2024, which sets general guidelines for RC-V to cover bodily injury and property damage to third parties caused by vehicles used in cargo transport. It repeals the requirement to maintain mandatory cover when the vehicle is not carrying out cargo transport, while allowing parties to contract optional cover for off-service situations, such as circulation without cargo, if provided for in the policy. SUSEP linked the change to operational and economic impacts of mandatory off-service coverage, noted that it was discussed with representative entities from the transport and insurance sectors, and framed the adjustment as aligning the insurance rules with road cargo transport legislation and the Insurance Legal Framework while preserving contractual freedom. SUSEP indicated the initiative is part of its 2026 Regulation Plan, which includes assessing improvements to the regulation of civil liability insurance applicable to road cargo transport.
