The Australian Securities and Investments Commission (ASIC) has made a legislative instrument increasing minimum net tangible assets (NTA) thresholds for specified fund operators from July 1, 2027, and introducing annual inflation adjustments. The instrument implements the policy announced in July 2026, raising thresholds to reflect inflation since their last update in 2013 rather than introducing a broader redesign of the requirement. The changes apply to responsible entities of registered managed investment schemes, operators of investor directed portfolio services and corporate directors of retail corporate collective investment vehicles. The NTA requirement supports operators’ ability to meet operating costs and fund a scheme’s transition if it fails. ASIC has also updated Regulatory Guide 166, AFS licensing: Financial requirements, to reflect the changes and will publish updated thresholds annually from 2027 after the relevant inflation data becomes available.
