A panel of the British Columbia Securities Commission (BCSC) has found that Vancouver resident Lucas Christopher Birdsall failed to comply with a statutory demand to produce records in an ongoing investigation and that his refusal amounted to obstruction of justice under British Columbia’s Securities Act. BCSC staff issued the demand in June 2024 and served it by mail, email and by posting it on Birdsall’s front door after unsuccessful attempts at in-person service. Despite receiving two deadline extensions, he did not provide any records. The panel concluded he failed or refused to produce records and things in his custody, possession or control, and dismissed eight applications made on his behalf during the proceedings. The BCSC’s Executive Director and Birdsall have been directed to make submissions on sanctions.
