Poland's Ministry of Finance and Economy has submitted a draft bill, adopted by the Council of Ministers, that would remove the current obligation for the Polish Financial Supervision Authority (KNF) to impose a financial penalty on insurers for every instance of late handling of motor insurance claims, including minor delays. The change is framed as enabling more efficient and proportionate supervision and as part of the government’s deregulation agenda. Under the proposal, financial penalties for untimely motor claims settlement would become discretionary, allowing KNF to tailor sanctions to the circumstances and the scale of the breach. The draft cites situations including delays in paying compensation, failure to respond to a compensation request for foreign claims, and late claims-handling proceedings conducted on behalf of the Insurance Guarantee Fund. The bill envisages the new rules entering into force 14 days after publication in Poland’s Journal of Laws.
