Thailand’s Securities and Exchange Commission has requested the public prosecutor to file a Civil Court lawsuit against Mr Pakorn Mongkoltada for purchasing shares in Aqua Corporation Public Company Limited (AQUA) while in possession of inside information, seeking the maximum applicable statutory civil sanctions. The Civil Sanction Committee had previously resolved to impose civil sanctions including total payments of THB 19,339,187, comprising a civil penalty, compensation equal to the benefit received or that should have been received, and reimbursement of the SEC’s investigative expenses, alongside a 14-month bar from serving as a director or executive. After Mr Pakorn refused to extinguish the case under the Committee’s decision, the SEC asked the prosecutor to pursue court-imposed civil sanctions requiring payment of THB 26,888,036.48 plus interest, together with a suspension from trading securities and derivatives and a director or executive ban at maximum statutory penalties. The SEC also referred the matter to the Anti-Money Laundering Office for action within its authority, noting that unfair securities trading is a predicate offence under the Anti-Money Laundering Act B.E. 2542 (1999).
