Honduras's National Banking and Insurance Commission has approved new rules for private credit bureaus on how to treat negative credit records arising from non-payment of mobile and fixed telephony, cable TV and internet services that were not provided, implementing requirements in Legislative Decree No. 75-2024. Under the rules, private credit bureaus must amend their contracts with these service providers to require a certification that data submitted to the bureaus does not include delinquent records related to non-provided services, whether acknowledged or disputed. Credit bureaus are prohibited from including such debts in credit reports, and customers whose credit rating was affected by their inclusion may file complaints with the bureau in line with the framework for private risk centres. Breaches can trigger sanctions under the applicable sanctions regime, and any cases not covered will be decided by the Commission. The rules enter into force upon publication in the Official Gazette La Gaceta, while the resolution is stated to be of immediate execution. The Secretariat General is tasked with arranging publication and communicating the decision to private credit bureaus and relevant supervisory units within the Commission.
