The Italian Securities Commission (Consob) opened a 30-day public consultation to gather market evidence and feedback on a proposed set of information obligations that crowdfunding service providers (CSPs) authorised under Article 4-sexies.1 of the TUF would be required to fulfil vis-à-vis Consob. The information collection is intended to support the creation of a database underpinning a risk-based supervisory model. The consultation covers three categories of information and documents: structured data on offers published and completed (Annex 1), based on project-related information under Article 16(1) of Regulation (EU) 2020/1503 and supplemented with additional data that Consob would obtain concurrently using the investigation powers in Article 30(1) of that Regulation; information on relevant changes to authorisation conditions under Article 15(3) of Regulation (EU) 2020/1503 (with an illustrative, non-exhaustive list in Table 1); and the key investment information sheet (KIIS) required under Article 6(1) of Consob Regulation No. 22720/2023, including the offer-related data set out in Tables 2 and 3. Consob has developed the SIcrowd portal as the single channel for meeting these information obligations. After the consultation, it will publish operational instructions covering access credential procedures for SIcrowd and the practical modalities for fulfilling the reporting obligations under consultation.
