The Central Bank of Russia has filed a claim with the General Court of the European Union in Luxembourg seeking to challenge European Union Council Regulation (EU) 2025/2600 of 12 December 2025, using the procedure under Article 263 of the Treaty on the Functioning of the European Union, in connection with measures affecting the bank’s sovereign assets. The bank argues that the regulation prohibits any direct or indirect transfer of its assets for an indefinite period and removes the possibility of judicial protection of rights to those assets, including through enforcement of court decisions or arbitration awards linked to the measures. It contends that this violates rights of access to justice and inviolability of property and the principle of sovereign immunity of states and their central banks under international treaties and European Union law, and alleges procedural breaches in the regulation’s adoption, including approval by majority vote rather than unanimity in a way it says bypasses Article 215 of the Treaty. The Central Bank of Russia stated it reserves all rights, claims, objections and remedies in relation to the regulation and any other European Union or member state measures taken in respect of the bank or its assets.
