The Brazilian Superintendence of Private Insurance (SUSEP) reported on director Carlos Queiroz’s participation in ENS’s “Regulatory Updates in Insurance and Reinsurance” event in São Paulo on 28 May, which focused on the impact of new CNSP and SUSEP regulation on implementing Brazil’s new Insurance Contract Law (Law No. 15.040/2024). Queiroz characterised the law as both a consolidation of already-settled judicial interpretations and a modernisation of the insurance contract framework. He pointed to the incorporation into statute of jurisprudence established by the Superior Court of Justice (STJ), including across different phases of the insurance contract and particularly in claims handling. The law was also described as setting insurance-specific rules, deadlines and scenarios for a complex contract type that previously relied more heavily on the Civil Code’s general contract provisions, while balancing protections for policyholders with provisions safeguarding insurers’ rights to support the proper functioning of insurance contracts.
