The Thailand Securities & Exchange Commission has launched a public consultation on proposed principles and draft amendments to operational guidelines for asset management companies (AMCs) to introduce additional ways to compensate when investment unit values or prices are calculated incorrectly. Under existing rules, compensation for incorrect pricing generally requires reducing the number of units held by buyers or sellers who benefited from the mispricing, equal to the difference between the incorrect and correct unit prices. The proposed changes would add an option for AMCs to use their own funds to compensate the affected mutual fund instead of adjusting investors’ unit holdings (where the benefiting parties still hold sufficient units at the time of compensation), and would permit monetary compensation to the mutual fund or affected parties in an amount greater than the actual loss, such as to reflect opportunity cost. Comments can be submitted via the SEC website consultation page, with the public hearing open until 21 September 2025.
