The Guernsey Financial Services Commission published a sanctions notice advising that the United Nations Security Council 1267/1989/2253 Committee has amended the entries for five individuals under the ISIL (Da’esh) and Al-Qaida regime, which is subject to an asset freeze, travel ban and arms embargo. The amended individuals are Ibrahim Ali Abu Bakr Tantoush (QDi.057), Al-Azhar Ben Khalifa Ben Ahmed Rouine (QDi.150), Sulaiman Jassem Sulaiman Ali Abo Ghaith (QDi.154), Shafi Sultan Mohammed Al-Ajmi (QDi.338) and Gulmurod Khalimov (QDi.372). Firms must check whether they hold accounts for, or otherwise have relationships with, any of the named individuals or any other designated person, entity or body, and must treat relevant funds, assets and economic resources as frozen with immediate effect if this is not already the case. Any findings must be reported immediately to the States of Guernsey Policy & Resources Committee and firms must comply with the reporting obligations in section 14 of the Sanctions (Bailiwick of Guernsey) Law, 2018; they must also refrain from making funds or economic resources available to designated persons (including entities owned or controlled by them or persons acting on their behalf), except where a permitted derogation or licence applies. Where an affected relationship is identified, firms must also notify the Commission and provide a Handbook Rule 12.37 report setting out, at a minimum, the relevant customer/beneficial owner/key principal or linked transaction/asset and the nature and value of the relationship or transaction. The notice points to the updated United Nations Security Council Consolidated List and notes that the amendments are automatically effective in the UK under the ISIL (Da’esh) and Al-Qaida (United Nations) (Sanctions) (EU Exit) Regulations 2019 and are given effect in the Bailiwick through the Sanctions (Implementation of UK Regimes) (Bailiwick of Guernsey) (Brexit) Regulations 2020.
