Moldova's National Commission for Financial Markets (CNPF) published consumer-protection enforcement decisions from its 5 May 2025 Board meeting, finding non-compliance by BT LEASING MD in a consumer leasing arrangement and rejecting an administrative appeal by INTACT ASIGURARI GENERALE SA against an earlier decision on motor third party liability (MTPL) claim handling. In a case triggered by a consumer petition, the CNPF found that BT LEASING MD breached mandatory requirements under Law No. 202/2013 on consumer credit contracts by concluding a leasing contract that did not match the offer presented in the pre-contractual information form and by including additional cost components. The review also identified abusive contractual clauses imposing fixed penalties on the consumer for non-performance of certain obligations, and the CNPF plans to bring court proceedings to have the abusive clauses declared null. Separately, the Board rejected INTACT ASIGURARI GENERALE’s preliminary request to overturn a CNPF decision that found breaches of Article 14(1) and Article 14(3)(a)-(b) of Law No. 106/2022 on compulsory MTPL insurance and required the regularisation of a claim file with full payment of the insurance compensation to the injured party.
