Morocco's Supervisory Authority of Insurance and Social Welfare (ACAPS), together with the Moroccan Insurance Federation (FMA), announced that compulsory All Risks Construction (TRC) and Decennial Civil Liability (RCD) insurance entered into force on 30 December 2024. The obligation follows the publication of two ministerial decrees in the Official Bulletin setting out the standard general conditions and key parameters for the compulsory policies. The decrees, prepared on ACAPS’s recommendation under the Insurance Code, specify elements including cover limits, deductibles, exclusions, and standard terms and conditions. TRC is mandatory for the client for the duration of works and must include damage cover (material damage to the building, materials and equipment on site) and civil liability cover (damage to third parties during works), protecting the owner and project professionals up to acceptance. RCD is mandatory for professionals responsible for the work, including architects, engineers and contractors, and applies from handover for 10 years, covering damage affecting structural solidity. The compulsory TRC and RCD requirements apply to buildings used for industrial, commercial, hotel, sports or accommodation purposes, and to residential buildings of more than three storeys or with a surface area above 800 m². A valid TRC insurance certificate is now required to obtain a building permit or a certificate of conformity.
