The Isle of Man Treasury issued a notice confirming that two individuals have been added to the UK Sanctions List under the Haiti sanctions regime, making them subject to an asset freeze in the Isle of Man. The regime is implemented locally via the Sanctions (Implementation of UK Sanctions) Regulations 2024, which give effect to the Haiti (Sanctions) Regulations 2022 and provide for financial sanctions against persons designated by the United Nations. The new listings are Dimitri Herard (UK Sanctions List ref HAI0012; UN ref HTi.009), described as a former Haitian police officer and former head of the National Palace General Security Unit, and Kempes Sanon, also known as “Kempes” (UK Sanctions List ref HAI0013; UN ref HTi.010), described as leader of the Les Argentins (Bel Air) gang. Both are cited in the notice in connection with actions threatening the peace, security and stability of Haiti, including links to gang activity and violence. The notice reiterates that firms identifying a possible match must immediately freeze any funds and economic resources they hold or control for the listed person, assess whether it is a true match, and avoid dealing with or making assets available to the designated person absent a legal exemption or licence. Where a true match is confirmed, frozen assets and suspected breaches or blocked attempted transactions must be reported to the Financial Intelligence Unit (FIU), and the guidance highlights that sanctions circumvention and non-compliance are criminal offences.
