The Guernsey Financial Services Commission published a Haiti sanctions notice confirming that the United Nations Security Council Committee established under Resolution 2653 has added Gran GRIF and Viv ANSANM to its sanctions list. The update is reflected in the UN Security Council Consolidated List and is automatically effective in the United Kingdom under the Haiti (Sanctions) Regulations 2020, which are given effect in the Bailiwick of Guernsey under Guernsey’s Sanctions Law framework. All businesses are required to check whether they hold accounts for, or otherwise have relationships with, the designated entities or other designated persons and to treat any relevant funds, assets or economic resources as frozen with immediate effect where not already frozen. Any findings must be reported immediately to the States of Guernsey Policy & Resources Committee and firms must not make funds or economic resources available (directly or indirectly) to designated persons, to entities owned or controlled by them, or to persons acting on their behalf, except where a permitted derogation applies or a licence has been issued by the Policy & Resources Committee; firms identifying an affected relationship must also notify the Commission and submit a report under Handbook Rule 12.37 with at least the relevant names and the nature and value of the relationship or transaction, as soon as reasonably practicable after meeting statutory reporting obligations.
