The Thailand Securities and Exchange Commission has revoked the approval of Mrs. Kanpakkaya Prasertkijkul (formerly Ms. Orawan Jaruratana) as a general investment consultant after finding she lacked required qualifications and misrepresented her educational background in her application. The SEC found she declared she held a bachelor’s degree, but verification with the named university showed no record of her being a student. The regulator concluded that misrepresenting educational information amounts to providing false or misleading information or concealing essential facts, indicating dishonesty and a prohibited characteristic for capital market business personnel. As a result, her approval was revoked and the SEC will not consider any new application from her to be approved as capital market personnel for two years, effective from 6 September 2025. In setting the two-year period, the SEC considered the individual’s roles and conduct, any penalties already imposed, the impacts and any damages or benefits, any corrective or obstructive actions affecting the SEC’s operations, and other records indicating unsuitability. The SEC also reiterated that applicants must submit accurate information and urged business operators to thoroughly verify documents and information when recruiting and appointing personnel.
