A new statutory framework and related Ontario Securities Commission (OSC) Rules came into force on 1 September 2025 to facilitate distributing amounts collected under disgorgement orders to investors who were directly harmed by the underlying misconduct. Disgorgement is a monetary sanction imposed by the Capital Markets Tribunal or the Ontario Superior Court of Justice requiring respondents to pay to the OSC amounts obtained through non-compliance with Ontario securities law or commodity futures law. To support the new framework, the OSC launched a dedicated website section where investors can view new disgorgement orders, track amounts collected under each order, register to receive updates about potential future distributions, and access information on any related distribution process including how to submit a claim.
