The European Banking Authority has opened three public consultations on draft Regulatory Technical Standards and Guidelines to support the new Capital Requirements Directive framework for EU branches of third-country credit institutions. The package covers booking arrangements, eligible instruments for the capital endowment requirement and supervisory cooperation, aiming to promote consistent implementation across Member States and improve comparability and cross-border supervision. The draft Regulatory Technical Standards on booking arrangements set a methodology for identifying and recording assets and liabilities booked or originated by a third-country branch, including off-balance sheet items, and specify minimum content for the registry book and related risk information. Draft Guidelines on capital endowment instruments set out additional eligible instruments beyond cash and debt securities issued by Member State central governments or central banks, and specify minimum operational conditions intended to ensure those instruments are effective for the capital endowment purpose. Draft Regulatory Technical Standards on cooperation establish modalities for information exchange and coordination among competent authorities supervising branches and entities of the same third-country group, including arrangements for colleges of supervisors for class 1 third-country branches in both going-concern and emergency situations. The consultations close on 10 October 2025. A public hearing on the three products is scheduled for 3 September 2025, with registration due by 1 September 2025.
