The Australian Securities & Investments Commission (ASIC) has withdrawn two outdated regulatory guides and made minor, technical updates to two guides on licensee conduct obligations, as part of its program to simplify and clarify regulatory guidance. Withdrawn guidance includes Regulatory Guide 64 on ASIC’s approach where companies fail to lodge certain documents and circumstances in which proceedings against a company secretary would be withdrawn, and Regulatory Guide 40 on transaction fee disclosure for bank, building society and credit union deposit and payments products. Updated guidance covers Regulatory Guide 104 on Australian financial services licensing and Regulatory Guide 205 on credit licensing, with amendments described as minor and technical to maintain accuracy and clarity. ASIC also pointed firms and consumers to alternative resources, including its Company annual review webpage for lodging obligations, Moneysmart.gov.au for information on banking products, and Regulatory Guides 168 and 221 for disclosure good practices.
