BCFSA’s regulatory investigation and a subsequent hearing found Foxwell to have violated sections 43(1)(a) and 43(2) of the Real Estate Services Act, which captures conduct that is contrary to the best interests of the public, undermines public confidence in the real estate industry, or brings the industry into disrepute, including conduct outside of professional activities. The convictions related to a December 15, 2021 traffic stop and included refusing to put his vehicle into park, resisting arrest, assaulting a police officer, refusing to provide a breath sample, and refusing to provide his name. The licence suspension runs for 10 months until June 2026, at which point the licence can be reinstated, and Foxwell must pay CAD 17,298.50 for investigation and hearing expenses.
