The Isle of Man Financial Services Authority has published a new notification and breaches form that firms must use when submitting notifications and breaches to the Authority, intended to simplify the notification process. The form applies to submissions under the Financial Services Act 2008, Insurance Act 2008, Designated Businesses (Registration and Oversight) Act 2015, Beneficial Ownership Act 2017, and the Anti-Money Laundering and Countering the Financing of Terrorism Code 2019. It must also be used for notifiable matters under associated regulations and guidance, and for any direction, condition or requirement applied to a firm’s licence, authorisation or registration. The form replaces the previous notification form used by class 1 firms for notification under the Financial Services Act 2008, with exceptions for notifications submitted via the DNFBP Portal and the portal used for funds notifications, and where existing templates apply (including fit and proper notifications, surrender notifications, and the banking outsourcing form). The form is available on the Authority’s Returns/Forms webpages and, for designated businesses, on the Oversight Obligations webpage. The Authority noted that the outsourcing form is currently used only by banking firms and will be reviewed in due course.
