The Brazil Securities Commission (CVM) Board accepted a proposed term of commitment in a sanctioning proceeding involving Housi Serviços Digitais S.A., as hotel operator of the VN Casa Faria Lima condominium, and Alexandre Lafer Frankel, as partner and chief executive officer of the operator. The decision diverged from the view of the CVM’s Term of Commitment Committee, which had found acceptance of the settlement proposal inconvenient and untimely. Under the accepted proposal, the respondents will pay BRL 200,000 to the CVM, split between BRL 150,000 from Housi Serviços Digitais S.A. and BRL 50,000 from Frankel; the CVM’s Federal Specialized Attorney’s Office found no legal impediment to the agreement. The proceeding was opened by the Securitization and Agribusiness Superintendence to investigate alleged irregularities related to the company’s 2022 and 2023 quarterly and annual financial statements (a possible recurring breach of Article 33 of CVM Resolution 86) and the financial statements for the year ended 31 December 2021 (a possible breach of Article 31 of the then-applicable CVM Instruction 602).
