The Italian Securities Commission (Consob) has published a Consob Notebook titled “Greenwashing and consumer protection for a sustainable economy”, providing an integrated overview of the EU and Italian legislative measures designed to steer private savings toward sustainable investments. The paper also defines greenwashing and describes how it can operate in the investment relationship. It outlines potential remedies available to investors whose investment decisions have been distorted by greenwashing, highlighting the sensitivity and complexity of claims for damages and questions around contract invalidity or termination. The analysis notes that the existing European and national framework in this area is complex and amenable to improvement, and was prepared by authors from Consob and the University of Bologna and the University of Naples Federico II.
