The Brazilian Superintendence of Private Insurance (SUSEP) reported that the statutory deadline of 15 July 2025 for entities carrying out mutual patrimonial protection activities without SUSEP authorisation to register under Complementary Law No. 213/2025 has elapsed, with 2,217 associations completing the registration within the period. Registered entities are now listed as “in regularisation with SUSEP”, allowing them to continue operating while they progress through the remaining legal steps. Registration is the initial stage of the regularisation process and a prerequisite for eventual recognition as a regular entity supervised by SUSEP, requiring greater transparency on structure, governance and operating model. Associations that did not register by the deadline and continue operating are deemed irregular and may face administrative, civil and criminal liability. Full regularisation will require submission of a service agreement with an administrator authorised by SUSEP. Applications to authorise the establishment of such administrators will be accepted only after SUSEP approves the implementing regulation currently being drafted; until then, associations remain in a transitional regularisation status under Complementary Law No. 213/2025 and forthcoming secondary rules.
