The Luxembourg Commission de Surveillance du Secteur Financier has postponed its planned notification to certain financial entities that they cannot be exempted from reporting a major incident when the reporting deadline falls on a weekend day or a bank holiday. In a 15 January 2025 communiqué, the CSSF had indicated it would notify the entities concerned before the end of February 2025, but it has now deferred this step because the relevant provision in Article 5(5) of the regulatory technical standards under Commission Delegated Regulation (EU) 2025/301 refers to the NIS 2 Directive. The CSSF considers it cannot proceed until the NIS 2 Directive is transposed into national law, and will notify the affected entities only once that occurs.

Luxembourg Commission de Surveillance du Secteur Financier postpones notifications on weekend and bank holiday major incident reporting obligations pending NIS 2 transposition
The Luxembourg Commission de Surveillance du Secteur Financier has delayed notifying certain financial entities about exemptions from reporting major incidents on weekends or bank holidays. This postponement is due to the need for the NIS 2 Directive to be transposed into national law, as referenced in Article 5(5) of the regulatory technical standards under Commission Delegated Regulation (EU) 2025/301. Notifications will occur once the directive is transposed.
