The Thailand Securities and Exchange Commission has asked the public prosecutor to file a civil lawsuit against Mr. Suthee Siripornpitak for alleged manipulation of the price or trading volume of RPCG Public Company Limited shares, seeking the maximum applicable civil sanctions. The Civil Sanction Committee had previously resolved to impose civil sanctions on two offenders in the case, including total payments of THB 71,729,832 covering civil penalties, compensation equal to benefits received or that should have been received, and reimbursement of SEC investigative expenses. The sanctions also included trading suspensions of 14 months or 8.5 months and bans from serving as directors or executives of 28 months or 17 months, depending on the offender. One offender agreed to comply, but Mr. Suthee refused, prompting the SEC to request court proceedings seeking THB 94,643,271.70 plus interest and maximum statutory trading and management prohibitions. The SEC also referred the matter to the Anti-Money Laundering Office for action within its authority, noting that the unfair securities trading misconduct constitutes a predicate offence under the Anti-Money Laundering Act B.E. 2542 (1999).
