The Australian Securities & Investments Commission (ASIC) has permanently banned New South Wales-based investment manager Brett Paul Trevillian from providing financial services and engaging in credit activities following his conviction for serious fraud. The banning took effect from 18 August 2025 and has been recorded on ASIC’s banned and disqualified register. The conviction related to Mr Trevillian creating and distributing forged performance verification reports that were used to solicit investments from clients of AlphaThorn Pty Ltd. The ban also prohibits him from controlling an entity that carries on a financial services business, performing any function involved in carrying on a financial services business, and engaging in, controlling or performing any function involved in credit activities; ASIC noted its powers to impose a permanent ban under the Corporations Act 2001 (Cth) and the National Consumer Credit Protection Act 2009 (Cth) where a person is convicted of serious fraud. Mr Trevillian was the sole director and secretary of Metal Alpha Pty Ltd and acted as investment manager for AlphaThorn; he was convicted on 20 December 2024 of two counts of making a false document to obtain a financial advantage under section 253 of the Crimes Act 1900 (NSW) and sentenced to three years’ imprisonment to be served by way of an intensive correction order.
