The Thailand Securities and Exchange Commission (SEC) has requested the public prosecutor to file a civil lawsuit against three individuals for allegedly manipulating the share price or trading volume of Readyplanet Public Company Limited (READY), after they did not agree to comply with civil sanctions imposed through the SEC process. The Civil Sanction Committee had previously resolved to sanction Mr Thaveerat Proongpattanaskul, Miss Pajaree Samattakitborriharn and Miss Phitchayada Sirithong with total payments of THB 233,113,379, covering civil penalties, compensation equal to the benefits received or that should have been received, and reimbursement of the SEC’s investigative expenses. It also imposed an 8.5-month prohibition on securities and derivatives trading and a 17-month ban on serving as directors or executives of securities issuing companies or securities companies. Following the lack of consent to settle, the SEC has referred the case for court action seeking total civil penalties of THB 279,673,856.10 plus interest, alongside trading prohibitions and director or executive bars at the maximum applicable statutory levels. The SEC has also reported the matter to the Anti-Money Laundering Office for consideration under its remit, citing unfair securities trading as a predicate offence under the Anti-Money Laundering Act B.E. 2542 (1999).
